摘要
我国现行矿业权制度与矿业用地制度之间在设置上、取得程序上,权利行使上存在冲突。应将土地使用权与矿业权合并处置,用矿业权对抗土地使用权等方式来协调矿业用地制度与矿业权制度之间的冲突。
There exist conflicts between mineral rights and mining land institution in establishment, obtaining procedure, and the right exercises. The land rights and mineral rights should be treated together, to harmonize the conflicts between mineral rights and mining land institution .
