摘要
现代民法要求将公民的环境权、国有资产所有权和监督保护权、消费者安全权等作为独立的新型的民事权利加以保护。民事公益诉讼制度适应了现代民法权利保障的要求,是新型民事权利的最重要的诉讼保障机制。
Modem civil law requests to establish the enviromnental rights, state-owned property possessive, supervisory and protecting rights, and safe rights of consumer as new civil rights independently for private law protection. The civil public interest litigation adapts to the requirement of rights security of modem civil law, and is a most important litigation security mechanism of the new civil rights.
