摘要
在技术是生命、信息是金钱的时代背景下,企业之间的竞争日益演化为对新技术和经营信息的追逐、开发和占有,商业秘密日益成为竞争的关键要素和各国司法保护的新热点。本文介绍了世界范围内三种保护商业秘密的典型立法例,对我国商业秘密法律保护的现状、缺陷以及我国商业秘密立法形式的选择进行了研究,认为我国的商业秘密法律保护体系仍需完善,专门立法势在必行。
Under the epoch background of which technique is life and information is competition between corporations has increasingly evolved the exploitation and possession money, the of the new technique and management information. Trade secret has increasingly become the key factor of competitions and the new hotspot of judicature protection all over the world. This thesis evaluates the theories and practices about the legislat areas of the world. Then it reviews the ion form of trade secret law in some representative countries and trade secret law in China to find its defects and limitations, and believes that our legal system must be constantly promoted and we do need a Uniform Trade Secret Law.
