摘要
现代市场经济体制的确立和高等教育机制改革引发了一系列“高校讼案”。解决这一社会问题首先应当摒弃传统计划经济体制下形成的高校行政主体身份的认识;其次,通过立法构建新型的关系,即明确高等院校和大学生之间的民事关系。
The building of modem market economical system and the transformation of the higher educational system have brought about a series of university actions. To solute the social problems, we should, firstly, cling the theory of university administrative subject, then construct the new theory of civil relationship between universities and students.
