摘要
传统法学方法论面对日新月异的社会发展渐渐显得有些力不从心,而法经济学方法论的引进则为法学研究注入了新的活力。它将法学与经济学合理地结合在一起,以效益为其核心和原则,一切法律制度都可以理解为促进资源有效配置的努力。通过对市场环境中各方主体之间的权利义务的分配,来降低社会运行的成本,提高经济行为的效率,从而给人们研究法律、研究社会带来收益。
Traditional law methodology gradually becomes weaker in rapid social development but the introduction of methodology of law economics adds new energy to law research. It reasonably combines jurisprudence with economics and regards benefit as its core and principle so that every legal system can be thought of as an effort to promote efficient allocation of resources. Social operation cost can be decreased and the efficiency of economic behaviors can be increased by allocating the rights and obligation among all parties in order to bring benefit for People to study laws and society.
