摘要
不完全合同在现实中大量存在,合同双方的权利义务处于不确定状态。引起合同不完全的原因有以下四个:语言的局限、当事的人疏忽、有限理性与信息不对称。对不完全合同的执行,是双方当事人和法庭所关注的问题。
A lot of incomplete contracts exist in present real life and the rights and obligations of both parties in contracts are in uncertain state. There are four causes to lead to incomplete contracts such as limitation of languages, negligence of the persons in charge, limited reason and information asymmetry. The execution of the incomplete contracts is concerned by both parties in charge and the courts.
