摘要
伴随着我国体育赛事商业开发的不断深入,赛事电视转播权作为一项重要的体育无形资产和财产权利,已被人们接受和认可,但对其法律性质的界定却存在理论上的不足。通过商品化权概念的提出,可看出体育赛事电视转播权作为体育商业化过程中出现的一种新型边缘权利,在权利的客体、内容和主体等方面,符合商品化权的特征。
With the further commercial development of athletic games in China ,the right of TV broadcast of athletic games as a kind of important intangible property and interest has been accepted and recognized by the public. But its definition of legal nature is still disputable. By bringing out the notion of authorized merchandise in the paper,it is believed that the right of TV broadcast of athletic games is a new marginal right in the process of merchandised sports and it is in accordance with the characteristics of authorized merchandise in its subject,object and contents.
