摘要
我国教唆犯的性质具有三重性,既具有独立性,又具有可罚程度上的从属性,同时还具有自己独特的属性,其中独立性居于主导地位。但这并不表明我国教唆犯的立法采取了共犯从属性说和共犯独立性说。
The abettor of our country has tri - nature ：independency, dependency and unique nature. Independency is leading. However,it cannot indicate that the legislation of abettor of our country is adopting the theory of joint crime dependency or joint crime independency.
