中国房地产预售制度:深层问题与对策建议 被引量:28

摘要 预售制度是目前国内房地产领域最普遍的一种制度规则。由于我国住房预售制度是特殊时期的产物,制度各方利益明显失衡,是一种单边风险机制,它为房地产开发商套取银行资金和获取暴利创造了条件,而风险则由消费者与银行来承担。因此,完善的住房预售制度就是让该制度成为相关利益主体对等与共同分担风险的机制,而且这种风险分担机制应贯穿于住房预售各个环节,包括严格的市场准入、市场退出、市场惩罚、市场风险分担与约束、信息披露与监管机制等,只有这样才能为建立一个健康、持续发展的房地产市场创造条件。 Pre-sell system for housing is the most common system rule in domestic real estate field at present. As it is the product in the particular period, there is obvious imbalance in various system aspects; it is a risk institution on the sole side, which serves for real estate developer to obtain the capital from the bank and sudden huge profits while the consumers and the banks shoulder the risk. Therefore, the improved pre-sell system is to turn the system into the institution that all the subjects concerned shoulder the risk together, and above all, this institution goes through every stage of house selling, including the strict market admittance, market withdrawal, market penalty, market risk shouldering and restraints, information exposure and supervising institution. Only in this way can the healthy real estate market with sustainable development can be established.
