摘要
欧洲联盟/欧洲共同体是第一个建立在法治基础上并在实践中贯彻实施法治原则的国际组织,法治已成为欧盟的一个基本原则。法治原则在欧盟的形成,一方面是因为欧盟基础条约为欧盟实行法治提供了法律与制度基础,另一方面是欧洲法院通过其司法实践推动了法治原则在欧盟的确立及其在实践中的发展。本文探讨了欧盟法治原则的条约基础、欧洲法院在欧盟法治原则形成与发展中的作用以及欧盟法治的一些基本特点,认为欧盟法治既具有法治的一般共性,又具有特殊性。
European Union/European Community is the first international organization based on principle of rule of law and implements this principle in practice.Rule of law has been one of the basic principles of the EU.Two major factors have contributed to the development of rule of law principle in the EU:one is the basic treaties of the EU providing the legal and institutional basis for the development of the principle,and the other is the European Court of Justice that has played a pivotal role in the development.This paper discusses the treaty basis of the principle,the role of the European Court of Justice and some characteristics of the practice of rule of law in the EU including some universal natures of rule of law as well as some specialties.
