摘要
警务活动中的人权保障是确定不移的。但是如何理解人权保障含义却一直存在着不同的见解和认识,从而导致警务认识活动和实践活动的偏差。从哲学视觉匡正警务活动人权保障的内涵及价值,提出了警务活动人权保障是程序意义上的人权保障。它强调的是人权保障与惩罚犯罪的对立,而不是与惩罚犯罪的配合和统一,被追诉人因此居于可以与国家抗衡的独立的诉讼主体地位。它全面体现了警务活动人权保障的价值。程序正义是人权保障的前提。
The guarantee of human rights in police service is uncertain. And there are different opinions and cognitions on how to understand this concept all the while, which leads to the warp in cognizing and practicing the police service. From philosophic point of view, the guarantee of human rights in police service is a procedural meaning for the connotation and value of this concept. This angle works actively on the establishment and perfection of guarantee of human rights.
