摘要
文章从知识经济、体制改革与全球化进程三个外在层面,分析构建企业人力资源法律的必要性;从雇佣双方心理契约失效与政府、企业与劳动者“三方机制”错位两个内向视角,解剖企业人力资源其法律构建的迫切性;最后从完善法律体系、保障法律实施等方面提出对策思考。
This paper analyzes the need to constitute Enterprise's HR Law from three external perspectives of knowledge economy, system reform and globallSization process. The urgency of Enterprise's HR Law constitution is dissected from two internal perspectives of invalidation of psychological agreement between employers and employees and the inconsistency of "three -party system" among government, enterprises and laborers. Finally countermeasures are proposed from the aspects of improving legal system and guaranteeing law implementation.
