摘要
为了探讨未成年人犯罪的刑事政策,完善司法保护制度,针对中国未成年人犯罪的定罪量刑及监禁处罚的现状,应用归纳分析和调查研究的方法,依据联合国少年司法最低限度标准规则,深入研究未成年人犯罪的定罪政策、刑罚政策和处遇政策,提出了对犯罪的未成年人适用非刑化、轻刑化和非监禁化的刑事政策,以达到及时、有效地预防和控制未成年人犯罪的目的。
For the sake of the crime policy for juvenile delinquency and perfecting the judicial protection system in view of the actuality of conviction and imprisonment to China＇s nonage criminals, analysis and investigation method was used to put forward the criminal policy of non - crucifixion, light - crucifixion and unimprisionment at the aspects of nonage crime policy of conviction,crucifixion and treatment according to the United Nation＇s lowest judicial limit for,juvenile delinquency which means to prevent and control the nonage＇ s crime timely and effectively.
