摘要
精神损害赔偿是国家赔偿制度中的重要组成部分,然而我国国家赔偿法没有明确规定精神损害赔偿制度,也未明确使用“精神损害赔偿”这一概念,这不利于充分保障相对人的合法权益,也不利于促进国家机关依法行使职权,在国家赔偿制度中规定精神损害赔偿势在必行。
Spirit damage compensation is an important constituent in the national compensation system. However, China compensation law doesn＇ t stipulate the spirit damage compensation system and doesn＇ t use the conception of ＂spirit damage compensation＂ explicitly either. These are harmful to fully safeguard relative person＇ s legitimate rights and interests and promote the government to exercise its authority legally. It＇ s urgent to stipulate the spirit damage compensation in the national compensation system.
