摘要
学生申诉权的法理基础探究,是解说、建构学生申诉制度的逻辑起点,是对学生申诉权的一种本源性的认知和探寻,也是解决学生申诉根本问题的进路。学校自治与特别权力关系是学生申诉权实现的基础。基于学校自治和特别权力关系的客观存在,学生申诉制度的设置,一方面是维护教育教学秩序稳定,实现教育目的的需要;另一方面是确保学生合法权益的不受非法侵犯,保障人权的需要。学生申诉权的制度保障的关键是建立健全学生申诉制度,把学生申诉权纳入制度化、程序化的轨道。学生申诉权的救济途径主要是行政救济和司法救济。
The lawful basic exploration of students' appeal right is the logic starting point to explain and construct students' appeal system. It is a kind of original cognition and exploration for the students' appeal right and the entrance to solve the fundamental problem of the students' appeal. School self-government and the special power relationship is the basis to realize students' appeal right. Based on the impersonal existence of school self-government and special right relationship, the setting up of students' appeal system is the requirement on one side to maintain the stable educational teaching order and realize educational objective, and on the other side to guarantee the legal rights and interests of students to avoid illegal encroachment and safeguard human rights. The key to the systematic guarantee of students' appeal rights is to establish and perfect students' appeal system and bring students' appeal into systematic and programmed channel. The relief ways of students' appeal right are mainly administrative relief and judicatory relief.
