摘要
宅基地因为无法流转造成了其上房产流转的困难,我国物权法对于宅基地的规定并未有所突破,但确定了宅基地使用权的物权效力。宅基地使用权作为物权,它的创设是如何的,它进行流转、、赠与等财产性的处分是否应当得到法律承认,宅基地的法律定性又是如何?本文对此问题作一个探析。
The non-conveyance of homestead results in the inconvenience of the transfer of the real estate thereon. The national real law fails to make a breakthrough with respect to regulations of homestead. It, however, assures the real right validity of using homestead. Since the fight to use homestead is real right, how is the right created? Should the disposition of property rights related to homestead, such as conveyance and bestowal, be legally acknowledged? What is the nature of homestead determined by legislation? This thesis seeks to make a legal analysis regarding those matters.
