摘要
劳动合同违约赔偿的特殊性是劳动关系本质属性的法律反映。劳动合同违约赔偿的归责原则具有区分性,即劳动者与用人单位应分别适用过错责任原则与严格责任原则;劳动合同违约赔偿的方式具有法定性,劳动法应否认约定赔偿的效力,实施法定赔偿制度;劳动合同违约赔偿的范围具有差异性,劳动者与用人单位应各自执行不同的赔偿标准。
the specialty of claim against breach of the labor contrast is the essence of labor relation in law. The doctrine of liability fixation of labor contrast is classified as the liability for wrongs for laborer and as the strict liability for employer; the doctrine of liability fixation of labor contrast is normative, labor contrast law should deny the effect of stipulated form and carry out statutory damage; the scope of claim against breach of the labor contrast is different in compensation amount according to the employer and laborer.
