摘要
海域使用权与渔业权之间存在结构性的冲突,难以协调。传统渔业权中包含养殖权和捕捞权两种性质截然不同的权利。如果将渔业权中的养殖权从渔业权中剥离,纳入海域使用权之中,问题便可迎刃而解。
There is a structural conflict between the maritime space use right and fishery right, which is hard to be coordinated. Traditional fishery right contained two different rights of breeding and harvesting aquatics. If we can peel off the right of breeding aquatics from fishery right and put it into the maritime space use right, the problem will be easily solved.
