摘要
行政契约在现代社会已被广为承认并得到大量运用。行政契约是公法契约的一种,公法契约应是对应私法上的契约的大概念。那么如何构建公法契约是现代社会公法契约能否最大限度地发挥其实际作用的关键。
The administrative contract has won widespread recognition and been used extensively in modem society. However, if we study them from a broader angle, well find the administrative contract belongs to the public law. The contract of the public law is a large concept in contrast to the contract of the civil law. There- fore how to construct the contract of the public law has become the key to bringing into full play the actual function of the public law contract in modern society.
