摘要
十届全国人大常委会第二十五次会议审议通过了《中华人民共和国物权法》。其中,涉及征地移民的有关政策,随着和谐社会理念的提出,势必将对我国的征地移民工作产生重要影响。为此,在认真研读《物权法》的基础上,梳理有关法律法规政策,剖析当前征地移民工作存在的主要问题,从房屋、土地等物权的角度,解读《物权法》的相关规定,并由此引发几点思考:随着农民生活水平提高,土地补偿标准要逐步提高;非征收项目补偿标准对征收项目补偿标准带来影响;社会保障安置方式将成为安置城郊移民的主要方式;获得安置区生产用地将逐步法制化。
Property Law was passed on the 25th conference of the Standing Committee of the National People＇s Congress of the People＇s Republic of China, which includes the policy on resettlement and land acquisition. With the putting forward of harmonious society concept, it will bring great impacts to the resettlement and land acquisition work in China. For this reason, on the basis of reading Property Law, we seriously analyze the main problems of present land acquisition and resettlement work and study the relative regulations of Property Law and then have some following thoughts. With the improvement of living standard of farmers, the land compensation standards will gradually increase; the compensation rate of requisition project will be affected by the other non-requisition projects; the way of social security will be main measure of arranging the neighborhood relocated persons. To gain the production land for relocated persons will be carried out in law.
