摘要
"法与(和)经济学",又称"法律经济学",或者"法律的经济分析",这是对法与经济学的一般理解。实际上,法与经济学就其内涵来说,可以划分为以麦乐怡为代表的"广义的法与经济学",以及以波斯纳为代表的"狭义的法与经济学",它们之间不但研究的内容有所不同,而且研究的方法也有所区别。正确区分它们之间的不同,既有理论意义,也有着现实意义。
Law and Economics, also called Economics of Law, or Economic Analysis of Law, is an common under-standing of law and economics. In fact, in terms of connotations, it can be divided into theory a narrow sense and theory in a broad sense. They are different not only in contents but also in research methods. It is significant to identify the difference between them both in theory and practice.
