摘要
随着知识产权法律制度的不断发展,世界许多国家为保护公平竞争,加速科技发展,都已将商业秘密作为一种知识产权加以保护,从而使之发展成为世界知识产权保护法律制度的一个重要组成部分。现代社会,商业秘密对于一个企业的生存和发展具有重要意义。经营者要想在竞争中处于不败之地,就必须努力开发和维持其商业秘密。商业秘密一旦被侵犯,不仅会给权利人造成无法估量的损失,而且对于建立和维护良性的竞争机制极为不利。
With the development of legal system on intellectual property rights, many countries in the world in order to protect the fair competition and accelerate the development of science and technology, they have protected the commercial secret as an intellectual property rights, thus make it become a very important part of world legal system. In the modern society, commercial secret has the important meaning for an enterprise＇s existence and development. If the operator wants to be in the invincible position in the competition, they must develop and maintain its commercial secret. Once the commercial secret is encroached upon, not only will cause uncountable loss to the oblige, but also make the establishment and maintenance of benign competitive system extremely disadvantageous.
