摘要
商业秘密作为一种特殊形态的信息,具有独特的法律特征,对于商业秘密的法律保护已经成为许多国家法律体系中的重要内容之一。而我国对于商业秘密的法律保护主要是通过相关法律规范进行的,存在一定的局限性。为了维护市场经济秩序,有效地预防和制裁商业秘密侵权行为,笔者在分析我国商业秘密法律保护的不足的基础上对如何完善商业秘密之法律保护进行了探讨。
Business Privacy is special information with unique legal properties. Protect of business privacy has becomes one of the major issues in legal system in many countries. However, the business privacy protect in our country is carried out by way of legal regulations, which is somewhat limited. The paper discusses how to protect our business privacy when legal defense is deficient, its purpose is to maintain economic order in market, while prevent and punish the tortfeasors.
