摘要
在政府采购合同的订立和履行过程中,存在着大量公权力的行使,现代法治社会需要对公权力的行使实行司法审查,以保证对依法行政的监督和对当事人合法权益的保障。对政府采购合同进行司法审查符合现行法律的规定,但更有待我国行政法和政府采购法的进一步完善。
There are enormous public power in the course of signature and fulfillment of Government Procure-ment Contract, Legal examination on public power are needed in mondern legalism. Legal examination on government procurement contract is the supervision of judicial administration as well as the protection of legitimate interests of litigants. Legal examination on government procurement contract is feasible in law. It even needs administrative law and government procurement law further perfect.
