摘要
行政追偿主体的确定是研究行政追偿制度的前提性问题,它具体涉及到谁追偿以及追偿谁的问题。我国现行法律的相关规定还有待完善。借鉴部分国家成功经验,应结合我国国情,确定具体情形下的行政追偿主体。
The determination of the main body is the premise to study the administrative recoupment system, which involves who pursues the recoupment and who recoups. The relevant regulations of present legislation need perfection. Drawing on the overseas experiences and combining with our national conditions, this paper researches into the determination of the main body of administrative recoupment in specific situation.
