摘要
近年来,由于全球化的影响、公共治理的兴起等多种原因,"软法"备受关注,国内外兴起了研究"软法"的热潮。本文旨在回答在经济领域如何实现"软法之治"的问题。本文首先对经济领域中的软法进行界定,探讨了经济软法的表现形式以及软法与经济法制之间的关系;其次,从软法机制及软法运行的外部环境两个方面分析了目前经济软法运行的障碍;最后,结合国内外的实践,提出了完善经济软法机制及其运行环境的具体措施。
In the recent years, ＂soft law＂ has been popular because of various reasons, such as ： the influence of globalization, the raise of public governance, etc. This article mainly points at the question how to realize the ＂rule of soft law＂ in economy area. It firstly tells the author＇s opinion about the identification of ＂soft law＂ in economic area, and analyses the relation between soft law and the legal system of economy area. And then it points out the obstacle that soft law meets with. Based on the discussion beyond, the author puts forward the solutions.
