摘要
西方学者的"自决权内外划分学说"主张将自决权划分为"内部自决权"和"外部自决权",这有其积极的一面,但更多的是其消极的一面。它不仅使使自决权及相关概念变得更加混乱,而且容易导致干涉他国内政的合法化;它不仅不能挽救反而会断送自决权原则的命运。为此,笔者主张用"学科划分法"代替"内外划分法"。
The theory on internal and external rights of self-determination of Western scholars advocates that self-determination rights should be divided into internal self-determination rights and external self-determination rights. It has positive aspects but more negative. It not only make self-determination right and its related concepts more confused, but also causes the legalization of the behaviors of interfering in other countries＇ internal affairs. It can＇t save but kill the destiny of the self- determination right principle. Therefore, the author advocates that the internal and external researching method should be replaced by the researching method in subject.
