从“南北矛盾”到“公私冲突”:卡尔沃主义的复苏与国际投资法的新视野 被引量:39

摘要 统治拉美乃至世界已有一个多世纪的卡尔沃主义,并非普遍认为的已经"死亡"。近来在拉丁美洲内外的一系列事件表明卡尔沃主义没有死亡,而且正在逐渐复苏,这也从侧面反映了当代国际投资法的重大转向。通过探寻这一系列事件,分析卡尔沃主义在何种程度上已经复苏,国际投资法理念在发生怎样的变化;并在批判分析卡尔沃主义与新自由主义两种制度弊病的基础上,探讨国际投资法的前景和出路;认为国际投资法的立法焦点已由过去的"强国"与"弱国"的对立,即"南北矛盾",转变为如今的"国家主权"对"公司主权"的对立,即"公私冲突",缔结一个利益均衡的全球性的投资条约将为期不远。 The Calvo doctrine which has dominated Latin America and even the world for more than a century is not " dead" as generally considered. Recently, a series of events inside and outside of Latin America indicate that the Calvo doctrine is not dead and is reviving step and step instead. This suggests from one side a great turnaround of the modern international investment law. By probing into this series of events, the paper has analyzed in which degree the Calvo doctrine has revived and which changes have taken place in the idea of the international investment law. Based on the criticizing and analysis of the drawbacks of two systems - the Calvo doctrine and new liberalism, the vista and way-out of the international investment law has been dealt with. It is considered that the focal point of the legislation of the international investment law has shifted from the past opposition between " great powers" and "weak countries" , namely " south-north contradiction" to the present opposition between "state sovereignty" and "corporation sovereignty" , namely "public-private conflict". The day in which a global investment law with interest equilibrium is concluded is not far off.
