摘要
人们往往不经意间将法学教育等同于大学法学院的教育,将培植法律人才的期望系于法学院一身,失望之余,又对法学院颇多苛责。综观各国法学教育的历史,对职业法律人才的培养越来越趋同于"法科教育+司法考试+实务研修"这一模式。法学院把持法科教育,实务部门通过司法考试和实务研修充当法科教育的质检部门和产品加工车间,获得了对法学教育相当的话语权。这种实务部门与法学院的配合,符合职业法律人才的培养规律,也有利于法学院秉持大学理想,免于沦为职业培训学校。
People often carelessly equate legal science education to the law school＇s education. They repose the training of legal personnel in law schools. While disappointed, they blame law schools. Looking at the history of national legal science education, there has been an increasing convergence on the model of ＂ law branch education ＋ judicature test ＋ practice training＂ in the vocational training of legal personnel. The law school controls the law branch education. Through the judicial test and practice training, the practice department acts as the quality test department of the law branch education and the product-rocessing workshop and obtains a discourse concerning the legal science education. This kind of coordination between the practice department and the law school conforms to the professional legal training＇s development law and is advantageous to the law school who can stick to the ideal of the university and prevent it from becoming a vocational training school.
