摘要
随着体育商业化的发展和一些高技术的介入,使兴奋剂检查变得越来越复杂,世界反兴奋剂组织通过立法不断规范反兴奋剂行动,可是,由于相关概念的表述不清楚,程序性的制度不如意,给实践中的反兴奋剂行动带来了诸多问题,通过分析世界反兴奋剂的发展现状,反兴奋剂的法制化进程以及反兴奋剂体制中存在的法律问题,提出反兴奋剂发展的相关建议,为我国的反兴奋剂立法实践提供参考。
With the ever - increasing commercialization of sports and intervention of high - tech, the issue of anti - doping might become more and more complex . World Anti -Doping Association enforces laws to fight against doping; however, due to the blurred concept and unsatisfactory system, a lot of problems stand in the way of anti - doping actions. This paper analyzes the status quo of world anti -doping development, the legalization process of anti -doping and legal problems in the anti - doping system and proposes relevant suggestions in the hope of providing reference for our anti -doping legislation practice.
