摘要
《劳动合同法》第八条首次明确对知情权作出了规定,《就业促进法》等法律中也有知情权的规定,知情权对维护劳动者的劳动权益更有特殊而重要的意义,必须对其性质、特征有一个正确的了解,要认识到劳动法上的知情权是劳动权的重要内容,也是构筑其他劳动权利的的基础和前提,具有基本权利固有的特征,因而,要采取有效的实现机制和救济机制保障知情权的实现。
Article 8 of Labor Contract Law establishes the right to know for the first time. There are regulations in the law of promotion of employment . The right to know is of great significance for safeguarding workers' right and interest. So we must understand its nature, characteristics. The right to know is one of contents in the workers' rights, the other rights of work are based on the right to know, which possesses inherent characteristic as basic rights. A set of effective mechanism must be built to realize it.
