摘要
随着物业管理的发展及广大业主权利意识的觉醒,许多亟待解决的实际问题,如业主的权利义务,业主、业主委员会与物业服务公司的法律地位和法律关系,《管理规约》的法律地位等浮现出来。这些问题的解决,最终都会归结到物业管理理论研究以及立法对策上来,我们只有从理论上科学认识和寻求物业管理内在的、必然的联系,运用立法途径才能从根本上解决这些复杂问题。
With the rapid development of property management, vast owners' awakening for rights, many urgent problems begin to emerge, such as owners' rights and obligations, legal station and relation of owners, owners committee and property service company, legal station of management stipulation and so on. Resolving these problems will boil clown to property management theory research and legislation countermeasure finally. Only if we understand scientifically and find out the internal, necessary relation of property management, apply the legislation approach can set- tie these complex problems thoroughly.
