摘要
在研究我国城市住宅小区物业管理纠纷问题的基础上,认为在我国的市场化物业管理模式实践中,由于大部分住宅小区的业主缺乏与物业服务企业讨价还价的能力,导致大量物业服务企业侵犯业主合法权益的物业管理纠纷出现。提出根据不同住宅小区业主在经济承受能力和集体行动能力上的特点,分别采取政府替代型、自我管理型、行政干预型和契约均衡型等多样化的物业管理模式。
This paper studies on property management disputes in urban housing communities. In the practice of the marketoriented property management pattern in China, property management companies always infringe upon property owners' legal rights and interests in property management disputes because the property owners in many communities are lack of the ability to bargain with property management companies. One thought to solve the problem is to adopt diversified property management patterns, such as governmentreplacing property management pattern, self - managing property management pattern, administrative - intervening property management pattern, and contract -equivalence property management pattern according to the economic capability and collective action ability of different housing community owners.
