摘要
民办高校落实法人财产权难,关键在于"法人财产权"是一个有争议的法律概念;"法人财产权"依附的民办高校"法人"概念也缺乏法律支撑,应明确财团法人的概念;《民办教育促进法》立法基点是"捐资"不是"投资",而我国法规允许"投资",社会主义初级阶段应明确"财产所有权"。
The implementation of legal property rights in non -govemmentschools is difficult because the legal property right is an arguable law conception. In addition, the concept of legal person of non - governmental schools where legal property rights depend on is short of law support, so we need to define the conception of corporation in the Law. Moreover, the basic point of the Law of Promoting Civilian - run Education discussed in the paper is Contribution rather than investment, but our laws just allow the investment. Therefore, it is quite necessary for us to clarify the legal property rights at the Primary Stage of Socialism.
