摘要
基于BOT项目的定义、特点、组织结构及合同关系的分析,对境外BOT火电项目的风险分摊原则、主要风险及其承担主体进行了分析,对境外BOT项目的风险如项目边界条件、市场和收益风险、燃料供应和运输风险、建设风险和不可抗力等进行了辨识,并结合境外火电建设项目的实践提出了针对各种类型的风险的管理和规避方法。
Based on the analysis of the definition, characteristics, organizational structure and contractual relations of BOT projects, this paper elaborates the major project risks as well as the risk allocation principles and the bearers of the risks, identifies risks of the overseas project in terms of boundary condition of the project, market and return risk, risk in the coal supply and transportation, construction as well as the force majeure. Considering practical experience in the overseas BOT thermal power project, it puts forward some useful risk management and elusion methods against all the possible risks.
