摘要
现阶段我国"一裁二审"劳动争议处理程序所存在的缺陷日益明显,特别表现在仲裁和诉讼程序当中。对此,本文建议引入劳动争议"双轨制"处理方式,将这种处理程序改造为适合中国国情的"裁审分立、各自终局"。"裁"、"审"应具体分工,并建立监督关系。仲裁分为约定仲裁和强制仲裁两类,大部分案件在约定仲裁下可仲裁终局,对涉及公共利益的进入到诉讼程序的强制仲裁案件,法院也只审理程序问题,以此完善我国劳动争议处理程序。
At this stage shortcomings of labor dispute handling procedures "Arbitrates first, then judgement" in China are increasingly obvious , specially performance in arbitration and judgement procedures. Regarding this, this article suggests the introduction of labor disputes "the two-track system" processing mode,and this process will be suitable for China's national conditions of the transformation of the "separation of the Disarmament Commission, each of finality." Arbitration and judgement should be specific division of labor and establishment the relations of supervision. The arbitration agreement is divided into two types of arbitration and compulsory arbitration, The majority of cases are in the final arbitration under the agreement arbitration.Involving the public interest into the proceedings of the compulsory arbitration cases,The court also heard only procedural issues to improve the process of China's labor dispute.
