摘要
网络链接不涉及对作品的复制,一般不构成对版权的侵权,但是不同形式的链接对版权人是否造成损害及其损害程度亦会不同。因此,需要对各种情形进行具体分析,以期既能保护版权人的权利,又能维护社会利益。
Internet link does not involve the duplication of works, and usually does not become the torts of copyright. But whether different forms of links will bring the damage to the copyright owners and the degree of damage is different. Therefore, it is necessary to analyze all kinds of situations to protect copyright and social interests.
