摘要
正确认识法律逻辑的研究对象,是该学科理论的重要内容。目前对法律逻辑研究对象的认识见仁见智,远未形成共识,不利于法律逻辑的发展。因而,正确认识法律逻辑的研究对象有着特别重要的意义。法律逻辑的研究对象可定义为:法律职业者在法律适用过程中特有的法律思维形式及法律思维方法,其核心是法律推理和法律论证。
To be familiar with the research object of legislative logic correctly is an important content for the theory of this subject. At present, the opinions in recognizing the research object of legislative logic are different, and the common sense does not come into being yet, which is not propitious for the development of legislative logic. So, it is very important to be familiar with the research object of legislative logic correctly. The research object of legislative logic can be defined as legislative thinking form and method in applYing process of the legislative professional, and its core is legislative reasoning and proof.
