摘要
人身危险性是刑法中的一个重要范畴,但只有将其限定在刑事法治的视野中来讨论,才能保证其发挥对刑罚适用的重要意义。探讨刑事法治视野中的人身危险性的内涵、意义,并尝试探讨如何把人身危险性纳入刑事法治的视野中。
Personal danger is a very important issue in criminal theory. But only if it is studied within the field of rule by criminal law, can it guarantee to bring its great significance into penalty implication. This essay probes into the meaning, the significance of personal danger within the field of rule by criminal law, and how personal danger will be admitted into the field of rule by criminal law.
