摘要
运用芝加哥学派的成本—收益分析手段,对行政复议及行政诉讼进行了相关的法经济学分析,并通过考察信访制度成本—收益状况,对信访制度的实效性进行论证,同时,解析信访被高频度选用的原因。援用诺斯的"制度变迁"与"路径依赖"理论剖析了信访制度的形成机制与制度变迁的必要性,并在此基础上提出信访制度的改革应当走诱致性制度变迁道路的观点。
The complaint letter and visit system is an administrative supplement relief system. This paper is intended to examine the difficulties of the complaint letter and visit system from the angle of law and economics. Firstly, it examines the feasibility of this system by citing the Chicago School＇ s cost-benefit analysis method, and then it invokes Nourse＇ s ＂system vicissitude＂ theory and ＂the way dependence＂ theory to analyze the formation and vicissitude of complaint letter and visit system. On the basis of the analysis, it puts forward the viewpoint that the complaint letter and visit system should walk on the causing system vicissitude road.
