摘要
在行政诉讼中,因被告改变被诉具体行政行为,原告同意并撤诉结案的行政案件大量存在,这实际上是行政机关与当事人就被诉具体行政行为"异化和解"的过程。但是从行政法的基本原则及行政权的特殊性质来看,行政诉讼和解必须受到严格限制。鉴于行政机关在行政诉讼中的优势地位以及行政权法定性、主动性、扩张性等特性,对行政诉讼和解的限制可以从规范行政机关改变被诉具体行政行为这一行为入手。
In administrative proceedings, the cases like the defendant to change specific administrative act, withdrawn and the plaintiff agree that the administrative cases were abundantly existed; actually it was the process of alternative dispute reconciliation between the executive authorities and the parties involved in the specific administrative act. However, in view of the basic principles of administrative law and special nature of administrative power, alternative dispute reconciliation must be restricted strictly. In view of the executive authorities set dominant position in administrative proceedings, as well as statutory, initiative, expansion and other characteristics of administrative power, we may start from standardizing how the executive authorities change specific administrative act, so as to restrict alternative dispute reconciliation.
