摘要
分析人道主义的义务与正义的义务之间的差别,可以发现,富国对穷国、富人对穷人的帮助不应被简单地理解为人道主义的义务,而应该被视为正义的义务。正义的义务所关注的是社会的基本结构和背景制度,以及在此基本结构和背景制度下的财富和资源的初始分配是否合理。如果穷国和穷人所处的不利地位是由基本结构和背景制度的不合理导致的,那么,对他们的帮助就是以正义为基础的责任行为,而不是以仁慈为基础的崇高行为。
By analyzing the difference between humanitarian duty and the duty of justice, this paper argues that the aids rich countries and rich people offer to poor countries and poor people should be regarded as duties of justice rather than humanitarian duties. The duty of justice focuses on the basic structure of society and the background institution, and the legitimacy of initial distribution of wealth and resource under the basic structure and background institution. If the less advantaged situations of poor countries and poor people are resulted from the unjustice of basic structure and background institution, then, the aid to them is an obligatory action based on justice, instead of a supererogatory action based on charity.
