摘要
从土地权属出发,阐述了土地权属争议的概念、类型,重点分析了土地权属争议形成的原因,在土地权属争议"调解在先,处理在后;行政在先,起诉在后"等处理原则的基础上,概述了土地权属争议"当事人协商、政府处理、行政复议、行政诉讼处理"等方法,期望为我国处理土地权属争议纠纷案件提供理论参考。
Land ownership was the key of cadastration in land arrangement of China. From the view of land ownership, this paper expounds the concept and types of land ownership dispute, analyzing the causes of the dispute. Based on the management principles in land ownership dispute, including "mediation going before action, administration going before prosecution", the paper discusses some methods for dealing with the dispute, expecting to provide theoretical reference for the solution of land ownership dispute.
