摘要
《信息网络传播权保护条例》的实施为图书馆使用和传播数字作品提供了法律依据,但它没有承认数字图书馆的法律地位,对数字图书馆在信息获取、信息服务及资源共享等方面造成了较大的影响。面对我国现行法律与数字图书馆建设的矛盾冲突,图书馆界应深入研究我国的法律法规,并积极投入到法律条文的修订中去。
The implementation of Information Network Transmission Right Protection ordinance provides the legal background for using and transmission of digital artwork, but it has not yet admitted the legal position of digital libraries, which inevitably causes great impact on information obtaining, information service and information resources sharing in the digital libraries. Facing the contradictions between the existing laws and regulations and the construction of digital library the library circles should make a study of the existing laws and regulations penetratingly, and take an active party in the revision work of the relating laws and regulations.
