摘要
执行程序中判断农村房屋的权属应以房屋登记簿为准;未登记的,应以相关审批文件为准,不认可未登记的农村房屋的物权变动效力。在宅基地使用权限制转让的背景下,"房地权利主体相一致"的原则是目前影响农村房屋执行的主要原因,在宅基地使用权转让日益松动的情况下,执行态势应有所改观。但农村房屋的生存保障性和宅基地使用权的福利性仍是农村房屋执行的滞碍因素。
In execution procedure, the criteria of house ownership in countryside should be in accordance with registration of house, or approval documents if no registration available. The effect of unregistered variation of jus ad rem of countryside house is not accepted. In the context of limited transfer of right of countryside dwelling house land usage, the main reason hinders the execution of countryside houses is the identity of ownership of land and house. In the circumstances that the transfer of right of coun- tryside dwelling house land usage became loosely regulated, the case could change. However, countryside houses seen as the safeguard of living and welfare still set barriers for execution on countryside houses.
