摘要
在简要介绍中、美两国政府信息公开制度建设的历程后,基于中国的《政府信息公开条例》和美国的政府信息公开制度体系,从信息公开的原则、权利主体、范围与例外、方式和程序、救济制度及各自存在的问题等角度进行比较分析;就中国政府信息公开制度的发展、政府信息公开制度的立法模式和立法层级、相关法律配套关系、公民意识培养和社会监督机制等方面作了思考。
After a brief introduction to the creating process of the system of openness of govemment information both China and U.S, the author gives a comparative analysis from the angles of the principle of information openness, the right of subjec, the scope and exception, its methods and procedures, the relief system, and their respective problems existed, based on ＂The Regulations on the Openness of Government Information of the P.R.C.＂ and the American system. The essay puts forth some ideas on the status of the right to know in the Constitution when developing the system of Chinese openness of government information, its legislative model and level, the relation of related laws, the cultivation of civic awareness, and social supervision mechanism etc.
