摘要
司法程序是法官、当事人等在纠纷解决的过程中所应遵循的步骤或方式。司法程序应当包括对立面的设置、中立的裁判者、有关的信息和证据、对立意见的平等交涉、确定的结果等五个方面。其价值特征则包括参与性、公开性、平等性、程序理性、效率性、终决性等方面。
Judicial procedure is the rules that judges and all parties should obey during the dispute resolution process. The elements of judicial procedure should contain opposing views, neutral judges, some relevant information and evidence, equal representation of opposing views and the certain result. And the value features of judicial procedure contain participatory, openness, equality, procedural rationality, efficiency and final decisiveness.
