摘要
程序正义以起点平等、规则公平来规范利益诉求,强调过程本身的建设,以过程为中心,在过程中去追求正义。在缺乏程序正义传统的中国,程序正义引导人们通过正常途径获得正当利益,引导社会形成和谐的秩序,调动人的积极性和创造性,培养人们对和谐秩序的认同感,因而构建和谐社会首先应当从程序正义出发,以其内在的价值引领和谐社会的构建。
Procedural justice which regulates interest demands by fair rules and equal starting line pursues justice from the process of construction of the procedure itself. Procedural justice leads people to legitimate gain through regular channels, the enthusiasm and creativity, the sense of approbation of harmonious order, Procedural justice is the prerequisite for building a harmonious society in china which traditionally lacks procedural justice.
