摘要
司法解释正当性的困境在于司法解释权力合法性的缺乏、内容上规范性解释的越权、法律效力上的无根据性等。为消除这种困境,需在制度上加以重新设计,包括其司法解释权力的授予、司法解释的权限以及其法律效力的制度认可。
The dilemma of the justification of judicial interpretation is that lack of the legality of the power to explain the law; the ultra vires of norm interpretation in the content and shortage of the Institutional base of its legal validity. In order to eliminate this dilemma, we should design the Institution which includes the endowment of the power of judicial interpretation, the confine of its power and the institutional base of its legal validity.
