摘要
2008年10月以来,索马里沿海地区海盗活动愈发猖獗,既有的国际法关于海盗罪的规定限制了对海盗行为实施全面有效惩治和打击,这也是使得索马里海盗问题日益凸现的原因之一。为了有效地打击海盗,联合国安理会第一次通过一项动用军事力量打击海盗的决议,这些具有强制性的规定将进一步推动现有的国际法已经确立的适用于打击海盗和武装抢劫以及适用于其他海洋活动的法律框架的修改与完善。
Piracy has become even more rampant in the coast of Somali since October 2008. The existing international laws regarding the provisions of the crimes of piracy on the Somali pirates have limitations on the implementation of comprehensive and effective punishments, which is one of the reasons for highlighting the rampant piracy in Somalia nowadays. In or der to crack down on piracy effectively, the UN Security Council has devoted to the use of military force against it for the first time in UN＇s history. These mandatory provisions will further promote the revision and perfection of the established legal framework applicable to combating piracy and armed robbery as well as other marine activities .
